Consolewinkel.nl has spoken to the PSJailbreak creators and they basically told them that PSJailbreak is legal and it contains no copyright code – meaning OZmodchips and other retailers have a pretty good case against Sony in the next few days.
To quote:
PSjailbreak is legal and contains no copyright code, that’s what the makers of the device are claiming. In a conversation forwarded to us, a Dutch retailer reveals that the creators of the device are insisting that Sony is just using ‘scare tactics’ to try and make people think twice before selling it. Moreover the creators are claiming that the device was primarily produced for homebrew on the PS3 console.

i think sony tried to block this exploit using update , but i think its impossible for them to do so... may be this is real and unpatchable exploit ... so sony has no other way , but to try thier usual scaring / filing case... etc... instead of filing case why dont they see cases file against them... class suit for removing OtherOS

if the dongles really are not stolen property then we are laughing in their face.
i dont use ps3 very often but i think this is funny and they cant stop us now, its well and truly OUT THERE IN THE PUBLIC DOMAIN.

Well, they can say the device isn't legal, but according to european law and US law it is illegal to circumvent a security measurement, and that's exactly what this device does.. Designed for homebrew? who are they kidding.. they perfectly know very well it is (or will be) for illegal games. Ofcourse they will tell anybody the thing is perfectly legal, they sell the damn thing, so if they got their money and offloaded their complete shipment they made a lot of profit...
It's a bit like cigarette manufacturers.. yes, the cigarette is perfectly safe......

They don't care if it used for backups or homebrew! facts are facts if they say their intent was building it for homebrew, they can't be sued, no metter what they were thinking, the guys are not inside their heads to know what theyr thinking. Sony has no case here, no sony code was used, no intelectual proprety used, it was builid with the intention of running homebrew, then you all come "oh but they circumvent copyright protection" and all that bla bla bla, yeah i can guarantee you there are more than dozen laws that allow you to do that, so sony got nothing here, they better move allong and issue they'r stupid firmware update! if they can patch it!

Of course Sony is using scare tactics.... While I must say I'm excited that I may be using my PS3 again soon, but Sony has every right to fight for their product and the hundreds of developers out there.

Either way, life is short and I'm ready to play some games!

what i would like to know is if sony could LEGALLY ban your console from playing any homebrew while online?
if the psjb or clones do NOT use any copyright code and you are NOT playing backups then how are you doing anything wrong?
just a thought because i still want to be able to get messages etc while playing mkv or playing emulators

i didnt realise it mentioned any homebrew.
i want to be able to watch hd movies through a mkv player or play emulators while i wait until my buds get online then i know its game time.
