It has been over a year since Sony released a firmware that disabled the OtherOS function on the PS3, several people at the time took court case’s, but none as yet have been fruitful, it seems that Sony has won in removing its OtherOS, or has it.
Just recently the Norwegian, Consumer Council has stated that the removal of OtherOS breaks its marketing act, Thomas Nortvedt from the Consumer Council, states that consumers have very little rights when it comes to games consoles he also states that the Consumer Council, should set an example of how much a company should be allowed to strip away from a machine, here is a roughly translated quote from the source:

Consumer Council are now choosing to complain about the game console PlayStation 3, the Consumer Ombudsman. It is after they received several complaints in 2010 that they have chosen to go through the terms of use for the machine, and thus argue that Sony marketing violates the Act.

According to the Consumer Council is the removal of the feature that gave consumers the ability to install Linux as the core of the matter.

    - Consumer Council received during 2010 several complaints about a software update for PlayStation 3, which removed the ability to use other operating system other than the manufacturer’s own. The change meant that consumers, including lost opportunity to install Linux and use the console as a normal PC for web surfing, playing legal copies of films or music, or use another software chosen, according to the Consumer Council.

It was in April 2010 that Sony updated the hardware on the PlayStation 3 machines, where they removed the ability to install alternative operating systems. This function has previously been completely open and supported by Sony.

If consumers still want to play PS3 games have no real opportunity to turn down the update – because newer games require the latest version of the hardware update. The removal of this feature should also have been the motivation for the hacker George “Geohot” Hotz recently “opened” the PS3 machine for all time.

    Right Resolve consumers

According to Thomas Nortvedt from the Consumer Council, owners of gaming consoles has very few rights.

    - When the Sony via the web link to the game console can remove significant properties under the guise that this is an update, so it shows how poorly made the digital consumer in reality, “said Nortvedt in a statement.

    - Sony gives itself the right to modify or remove features of the game console of their well-being. We consider this as an obvious violation of the Marketing Act and not least in confidence between producer and consumer.

He adds that there are examples where manufacturers exploit consumers’ lack of rights to remove features, without the consumer’s ability to turn down the changes.

Nortvedt believes it must set an example of how much can be stripped away from a product.

    - There must be a limit to what can be considered reasonable changes in the products we buy. Terms of agreement which provides manufacturers free to downgrade the product or reduce the functionality is unreasonable and in violation of the law, “said Thomas Nortvedt in the press release.

    - When it used terms such as updates and upgrades, arouses the legitimate expectation that the quality of the product gets better, not that you risk being left with an inferior product.

NB! The lawyer representing Nordisk Film Interactive had no opportunity to comment on this matter to the press four.

According to Nordisk Film Interactive, which is the supplier of the PlayStation 3, there are just under 400,000 PlayStation 3 machines in Norwegian homes.

Well excitement was created when waninkoko announced custom firmware for the ps3 with backup support and PSN(online gaming) it seems that he has posted what we would be expecting with V2 of his CFW for 3.55

New payload revolving around hermes and PL3
CFW patches which would allow for easy .pkg installation
Peek/ poke function used via flukes1 and kmeaw tools

To Quote a rough translation via google

    Waninkoko V2: New details

It’s a relatively quiet day for us on the scene, but here is something to cheer with a little info on the new version of Waninkoko CFW V2. The previous version of Waninkoko had created an uproar in the community, by the hundreds of PS3 bricks following the installation of the CFW. But do not worry about the V2 because it would have found the reasons for the bricks.

Here are some details on the CFW waninkoko V2:

    - A new payload for his CFW, based on the payload Hermes + on some functions of the payload PL3
-However, the payload, according Waninkoko not work on CFW Kmeaw.
The CFW-patches will be provided. pkg for easy installation
The CFW-use function Peek / Poke with some additional tools like the tools and CFW kmeaw Flukes1

Many people (who have passed the test of the brick) praised the first version, with the launch of backups without too many problems. Hopefully the new version of CFW waninkoko be a more stable version.

Drizzt, has compiled a new version of Gaia Manager verison 2.05. This new version brings even more stability by using a hardcoded payload as well as adding in some Syscall36. Also, Gaia Manager has always “cleaned up the Sony log’s since October 2010.” That feature is always been active and working!

    3.55 CFW ONLY
    DOWNLOAD: Gaia Manager v2.05

    Change Log:

    v2.05

    * Use harcoded payload (less crashes)
    * Use another payload (with syscall36), it should never crash inside game now
    * Reminder * Gaia Manager has the Sony logs cleanup since October 2010 and it’s always active and working

If your having trouble with black screens and freezes, make sure to run Lv2 v6 (OMG OMG OMG) then run fix permissions found below:

    DOWNLOAD: Lv2 v6

    DOWNLOAD: Fix Permissions

Yes, the screen does turn black, but do not worry. Just watch the HDD indicator light to make sure it didn’t freeze, then it will bring you back to the XMB.

Run the Lv2 OMG application every time before running Fix Permissions.

It seems that a lot of folks are having issues installing and running backups on there Ps3′s due to the bug in PL3 that effects file permissions. Here is what I have been doing to get around the black screen hangs and disc read errors.

    1. Fire up multiMAN, blackb0x, whatever ftp & transfer your backup
    2. Run your lv2 pkg of choice
    3. Run the fix permissions app that is installed from running the package

The app will go through the HD and correct the file permission errors that come with using PL3. I have been using this method after each game backup I install,
however if you install (ftp/copy) 5 at a time the app only needs to be run once and it will fix all 5 games as it does its magic to the entire drive.
Now as far as USB, hamster driven HD

Similar to the PSX-Store we told you about a while ago, Kmeaw has taken on and released the beginnings of something similar known as Homebrew PKG Repo (HPR). HPR basically allows you to download PKG files directly to your PS3 – think of it as the App store of the PS3.

It is still a WIP and we will keep you know of any future updates, you can download app below.

The Geohot vs Sony case is still ongoing and more drama has unfolded for you. Sony has made allegations that GeoHot’s actually owns a PSN name known as “Geo1Hotz” (thereby violating PSN ToS), but Geohots lawyers disagree and are calling for a dismissal of case all together. Now it could be very true that Sony may have created a fake account to “frame” Geohot (just like the donation trick they pulled), but looks like time will tell. (more…)

rms a dev on IRC, has released quite a handy app, that will help in identifying your console, here is what it gives you:

    PS3 Motherboard Revision

Which in return gives you which PS3 Model you have, it works on 3.41 using a dongle and works on 3.55 with GeoHot’s CFW and kmeaw’s CFW, here are a few images:

We posted here a few hours ago, about a homebrew application, which wiped the PS3′s activity log, just recently, another Dev called Chossy from PSX-SCENE has created a simmilar app, that wipes the log and replaces it with a fake one, here is a quote from the readme:

Erase Me Evidence Eraser PS3 v1.1
    (Stealthed as Fifa 08 v1.10)

Clean your pushlist/history files from your ps3 for people who dont use backup managers.

    Install package and run.
Press X to delete files and exit.
Press O to copy dummy files over.

Dummy files show 5 games played so not to look to obvious.
If you really want some fun after install FTP into the app BLES00132
and hex in some swear words in the game.dat/patch.dat & boot_history.dat
in the USRDIR folder the copy them across ;-)

also included is a stealth version of blackbox ftp (using Genji ID)

    N.B

No callback function added as yet so cant exit to xmb via ps button.
This will be fixed in next version.

There is a version for GeoHot’s CFW and a version for kmeaw’s CFW, as well as the source:

smokin has released a simple homebrew app which wipes your PS3 complete log history. This basically makes it impossible for Sony to know (or so we currently think) which apps/homebrew we have ran. To use simply run via XMB and it will flicker black and return to XMB as normal. You can download it below.

As if it wasn’t easy enough, there are 2 new CFW GUI makers on the web to help make your life a bit easier for creating your own patched PUPs for your CFW.

Coming from GX-Mods here is a simple CFW/OFW maker:

    Features :

    - Download the official 3.55 fw
    - Creating different custom firmwares
    - Verification (after downloading and creation) of the MD5sum

    New / fixed:

    - Addition of bspatch.exe that prevented the integration of patches

. NET Framework Version 4 is required.

    [DOWNLOAD GX-MOD CFW Maker]

And here is another one from the Trading-Post , its a bit lighter in size and requirements than the GX-Mods one but whatever suits your style:

    Simply download to anywhere.
    Extract it – Install it
Download 3.55ofw put it in where ever – That’s if you don’t already have this file.
Download Patched PS3UPDAT.PUP put it in where ever – That’s if you don’t already have this file.

    Execute CFWPatcher.exe

    1. Select bspatch Folder
    2. Select 3.55 OFW Folder
    3. Select Where to place the Modified 3.55 FW
    4. Select The Patched 3.55 Folder – If not found Massege pops up
    5. Select your Patch PUP File – CFW_v3.55.PUP / PS3UPDAT.PUP.bsdiff

    Click Execute

    wait till it’s done.

Open the New Folder and Execute PS3UPDAT.md5 / CFW_v3.55.md5 To check file.

FBANext, a multi-system emulator for the PS3, has been updated bringing custom firmware support, and better framerate.

    To quote:
    CHANGES (as of r417):
