    The PS Vita launched yesterday in Japan, we posted about it here, that was exciting news for all those standing in line at 7AM on a cold Japanese morning, those in the hacking community came to a bit of a snag, in that the newer PKG’s have had their AES Keys changed, here is a quote from well known hacker SKFU:

    I just got my tried to unpack the Twitter application for PS VITA and sadly I have to say that the AES key for PKG encryption and decryption changed.

    The PKG’s I used for my testings were pretty old and the key update was expected.
    Nevertheless it’s a bit disappointing but a new nice challange :)

    The PS3 can decrypt the new packages on firmware 4.00 which contains the new PS VITA PKG AES key for the PS3 <--> PS VITA content exchange feature. This means we can decrypt and get the content of the PS VITA PKG files via a 4.00 PS3. Sadly there’s no solution to re-encrypt it again, yet.

    It is now Saturday the 17th of December in Japan and the time is almost 9AM, the PS Vita has already been launched, to greet new console owners is a brand new Firmware update, Firmware 1.50 enables PSN and various features associated with that, download the update here.

    THIS AGREEMENT IS BETWEEN YOU AND SONY COMPUTER ENTERTAINMENT INC. (“SCE”). ACCESS TO OR USE OF THE SYSTEM SOFTWARE IN SCE’S PlayStation®Vita HANDHELD ENTERTAINMENT SYSTEM (“PS Vita”) IS EXPRESSLY CONDITIONED UPON ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. BY USING YOUR PS Vita, YOU REPRESENT THAT YOU ARE CAPABLE OF ENTERING INTO A CONTRACT UNDER THE LAWS OF YOUR JURISDICTION AND AGREE TO BE BOUND BY THIS AGREEMENT’S TERMS.

    This Agreement applies to any system software, firmware and Internet browser software included in the PS Vita and any patches, updates, upgrades or new versions of that system software, firmware and Internet browser software provided to or made available for your PS Vita through any SCE or Sony service or online network, PlayStation®Network, SCE website or PS Vita game media. All software and firmware described in this paragraph is referred to collectively as “System Software”.

    NOTE: IF YOU ARE A UNITED STATES RESIDENT OR A RESIDENT OF A COUNTRY IN NORTH, CENTRAL OR SOUTH AMERICA, TO THE FULLEST EXTENT PERMITTED BY LAW, THIS AGREEMENT CONTAINS A BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER PROVISION IN SECTION 8 THAT AFFECTS YOUR RIGHTS UNDER THIS AGREEMENT AND WITH RESPECT TO ANY “DISPUTE” (AS DEFINED IN SECTION 8) BETWEEN YOU AND A “SONY ENTITY” (AS DEFINED IN SECTION 8).     1. LICENSE GRANT

    Subject to this Agreement’s terms, SCE grants you a non-exclusive, non-commercial right to use System Software solely on your PS Vita. Your rights to use previous versions of System Software other than the current version of System Software terminates as soon as you can receive or have the most current version of System Software installed on your PS Vita.

    Certain license terms for SCE-licensed, third-party software or service licensed may require that SCE provide you with notices and license terms for that third-party software or service. These notices and license terms and are available to you at http://www.scei.co.jp/psvita-license/index.html or any other place which SCE thinks appropriate.

    All rights to use System Software are granted by license only, and you are not granted any ownership rights or interests in System Software. SCE and its licensors retain all intellectual property rights in System Software. All use of or access to System Software is subject to this Agreement’s terms and applicable intellectual property laws. Except as this Agreement expressly grants, SCE and its licensors reserve all rights in System Software.

    2. RESTRICTIONS

    You may not lease, rent, sublicense, publish, modify, patch, adapt or translate System Software. You may not reverse engineer, decompile or disassemble System Software, create System Software derivative works, or attempt to create System Software source code from its object code. You may not
    (i) use any unauthorized, illegal, counterfeit or modified hardware or software with System Software; (ii) use tools to bypass, disable or circumvent any PS Vita encryption, security or authentication mechanism;(iii) re-install earlier versions of the System Software (“downgrading”), (iv) violate any laws, regulations or statutes or rights of SCE or third parties in connection with your access to or use of System Software; (v) use any hardware or software to cause System Software to accept or use unauthorized, illegal or pirated software or hardware; (vi) obtain System Software in any manner other than through SCE’s authorized distribution methods; or (vii) exploit System Software in any manner other than to use it with your PS Vita according to the accompanying documentation and with authorized software or hardware, including use of System Software to design, develop, update or distribute unauthorized software or hardware for use in connection with the PS Vita.

    These restrictions will be construed to apply to the greatest extent permitted by the law in your jurisdiction.

    3. SERVICES AND UPDATES; THIRD PARTY AGREEMENTS AND CONTENT

    SCE may provide to your certain System Software updates, upgrades or services. Some updates, upgrades or services may be provided automatically without notice to you when you sign onto PlayStation®Network and others may be available to you through SCE’s website or authorized channels. You consent to SCE providing you these automatic updates, upgrades and services. Services may include latest update or download of a new release of System Software containing security patches, new technology or revised settings and features that may prevent access to unauthorized or pirated content or prevent use of unauthorized hardware or software in connection with the PS Vita.

    You must install or have installed the most current version of System Software as soon as you reasonably can. Some updates, upgrades or services may change your current settings, cause a loss of data or content or cause functionality or feature loss. SCE recommends that you regularly back up all data that you can.

    Third parties may make other services or content available to you, and they may require you to accept their separate terms and conditions and privacy policy. System Software may refer to, display or provide you with links to websites or content that third parties independently operate or maintain (“Third Party Content and Links”).

    SCE and its affiliated companies do not control or direct Third Party Content and Links nor do SCE and its affiliated companies monitor, approve, endorse, warrant or sponsor any Third Party Content and Links. SCE and its affiliated companies have no liability to you for any Third Party Content and Links. Your reliance on any Third Party Content and Links is at your own risk, and you assume all responsibilities and consequences resulting from your reliance.

    Please see your PS Vita documentation for information on possible access controls to Third Party Content and Links via PS Vita’s or PlayStation®Network’s parental controls.

    4. INTERNET FEATURES

    Using System Software features that require access to an Internet connection (“Internet Features”) may require you to obtain wireless Internet service from a third-party wireless provider and/or mobile network operator (“Internet Service Provider”). Internet access may NOT be available at your location, be free of charge or free from interruption or disconnections. If you wish to obtain Internet Service Provider services for your PS Vita, you must enter into the necessary Internet Service Provider agreements for those services. You are responsible for all fees incurred in connection with access to or use of the Internet.

    Certain Internet Features may operate depending upon Internet connection factors not under SCE’s control. Browsing websites, playing programs or downloading programs or data may result in viruses, loss or corruption of data or other problems, and you assume all responsibilities and consequences resulting from engaging in these activities through your PS Vita.

    When you enable location services for certain third party applications on your PS Vita, you acknowledge that SCEI may send your latitude and longitude information and IP and / or MAC address to the third party service provider (“Third Party”) in order for the Third Party to render the services requested by you.

    In rendering the service to you, the Third Party may require you to accept their separate terms and conditions of service and / or privacy policy. Please refer to the Third Party’s privacy policy for details on how this information will be used.

    5. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

    System Software is provided “AS IS” without any express or implied warranties. SCE, its affiliated companies and licensors expressly disclaim any implied warranty of merchantability, warranty of fitness for a particular purpose and warranty of non-infringement.

    IN NO EVENT ARE SCE, ITS AFFILIATES AND LICENSORS LIABLE FOR ANY LOSS OF DATA, LOSS OF PROFIT, OR ANY LOSS OR DAMAGE, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, HOWEVER ARISING, AS A RESULT OF ACCESSING TO OR USING SYSTEM SOFTWARE. SO LONG AS THIS PROVISION IS ENFORCEABLE IN YOUR JURISDICTION, THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

    6. VIOLATION OF AGREEMENT; TERMINATION OF RIGHTS AND SCE REMEDIES

    If SCE determines that you have violated this Agreement’s terms, SCE may itself or may procure the taking of any action to protect its interests such as disabling access to or use of some or all System Software, termination of your access to PlayStation®Network, denial of any warranty, repair or other services provided for your PS Vita, implementation of upgrades or devices intended to discontinue unauthorized use, or reliance on any other remedial efforts as reasonably necessary to prevent the use of modified or unpermitted use of System Software.

    SCE, its affiliates and licensors reserve the right to bring legal action in the event of a violation of this Agreement. SCE may participate in governmental or private legal action or investigation relating to your use of System Software.

    7. EXPORT CONTROL AND COMPLIANCE WITH LAWS

    System Software may contain technology that is subject to certain restrictions under export-control laws and regulations. As such, the PS Vita may not be exported or re-exported to persons and entities in violation of these laws and regulations. You must comply with these laws when using System Software.

    8. BINDING INDIVIDUAL ARBITRATION FOR CERTAIN RESIDENTS

    The following terms in this Section 8, to the fullest extent permitted under law, only apply to you if you are a resident of the United States or a country in North, Central or South America.

    The term “Dispute” means any dispute, claim, or controversy between you and SCE, Sony Computer Entertainment America LLC or any other SCE affiliate (“Sony Entity”) regarding use of System Software, whether based in contract, statute, regulation, ordinance, tort (including fraud, misrepresentation, fraudulent inducement or negligence), or any other legal or equitable theory, and includes the validity, enforceability or scope of this Section 8 (with the exception of the enforceability of the Class Action Waiver clause below). “Dispute” has the broadest possible meaning that will be enforced.

    If you have a Dispute with any Sony Entity or a Sony Entity’s officers, directors, employees and agents (“Adverse Sony Entity”) that cannot be resolved through negotiation as required as further described below. Other than those matters listed in the Exclusions from Arbitration clause, you and the Adverse Sony Entity must seek resolution of the Dispute only through arbitration of that Dispute according to Section 8′s terms and not litigate that Dispute in court. Arbitration means that the Dispute will be resolved by a neutral arbitrator instead of in a court by a judge or jury.

    YOU AND THE SONY ENTITIES AGREE THAT ANY CLAIM FILED BY YOU OR BY A SONY ENTITY IN SMALL CLAIMS COURT IS NOT SUBJECT TO THE ARBITRATION TERMS CONTAINED IN THIS Section 8.

    IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION AND CLASS ACTION WAIVER IN THIS SECTION 8, YOU MUST NOTIFY SCE IN WRITING WITHIN 30 DAYS OF THE DATE THAT YOU ACCEPT THIS AGREEMENT. YOUR WRITTEN NOTIFICATION MUST BE MAILED TO SONY COMPUTER ENTERTAINMENT INC. CARE OF SONY COMPUTER ENTERTAINMENT AMERICA LLC, 919 EAST HILLSDALE BLVD., FOSTER CITY, CA 94404, ATTN: LEGAL DEPARTMENT – WAIVER AND MUST INCLUDE: (1) YOUR NAME, (2) YOUR ADDRESS, (3) YOUR PLAYSTATION®NETWORK ID, IF YOU HAVE ONE, AND (4) A CLEAR STATEMENT THAT YOU DO NOT WISH TO RESOLVE DISPUTES WITH ANY SONY ENTITY THROUGH ARBITRATION.

    IF YOU HAVE A DISPUTE WITH ANY SONY ENTITY, YOU MUST SEND WRITTEN NOTICE TO SONY COMPUTER ENTERTAINMENT INC. CARE OF SONY COMPUTER ENTERTAINMENT AMERICA LLC, 919 EAST HILLSDALE BLVD., FOSTER CITY, CA 94404 ATTN: LEGAL DEPARTMENT – DISPUTE RESOLUTION TO GIVE THE ADVERSE SONY ENTITY AN OPPORTUNITY TO RESOLVE THE DISPUTE INFORMALLY THROUGH NEGOTIATION.

    You agree to negotiate resolution of the Dispute in good faith for no fewer than 60 days after you provide notice of the Dispute. If the Adverse Sony Entity does not resolve your Dispute within 60 days from its receipt of notice of the Dispute, you or the Adverse Sony Entity may pursue your claim in arbitration pursuant to the terms in this Section 8.

    ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL ACTION, UNLESS BOTH YOU AND THE ADVERSE SONY ENTITY SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION.

    If you or the Adverse Sony Entity elect to resolve your Dispute through arbitration, the party initiating the arbitration proceeding may initiate it with the American Arbitration Association (“AAA”), www.adr.org, or JAMS www.jamsadr.com. This Section 8′s terms govern if they conflict with the rules of the arbitration organization that the parties select.

    The Federal Arbitration Act (“FAA”) governs the arbitrability of all Disputes involving interstate commerce. However, applicable federal or state law may also apply to the substance of a Dispute. For claims of less than $75,000, the AAA’s Supplementary Procedures for Consumer-Related Disputes (“Supplementary Procedures”) apply, including the schedule of arbitration fees set forth in section C-8 of the Supplementary Procedures, for claims over $75,000, the AAA’s Commercial Arbitration Rules and relevant fee schedules for non-class action proceedings apply.

    The AAA rules are available at www.adr.org or by calling 1-800-778-7879. Further, if your claims do not exceed $75,000 and you provided notice to and negotiated in good faith with the Adverse Sony Entity as described above, if the arbitrator finds that you are the prevailing party in the arbitration, you will be entitled to recover reasonable attorneys’ fees and costs as determined by the arbitrator, in addition to any rights to recover the same under controlling state or federal law afforded to the Adverse Sony Entity or you.

    The arbitrator will make any award in writing but need not provide a statement of reasons unless requested by a party. The arbitrator’s award will be binding and final, except for any right of appeal provided by the FAA, and may be entered in any court having jurisdiction over the parties for purposes of enforcement.

    You or the Adverse Sony Entity may initiate arbitration in either San Mateo County, California or the county in which you reside. If you select the county of your residence, the Adverse Sony Entity may transfer the arbitration to San Mateo, County if it agrees to pay any additional fees or costs you incur as a result of the change in location as determined by the arbitrator.

    If any clause within this Section 8 (other than the Class Action Waiver clause above) is illegal or unenforceable, that clause will be severed from this Section 8, and the remainder of this Section 8 will be given full effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Section 8 will be unenforceable, and the Dispute will be decided by a court.

    This Section 8 survives this Agreement’s termination.

    9. GOVERNING LAW AND VENUE

    If you reside in Japan or country/area located in East Asia or Southeast Asia, this Agreement is governed by, construed and interpreted in accordance with the laws of Japan except for its conflict of law rules. Any dispute arising under or in relation to this Agreement, shall be exclusively submitted to the Tokyo District Court in Tokyo, Japan.

    If you reside in Europe, Africa, Australia and Oceania, Middle East, India or Russian Federation, this Agreement is governed by, construed and interpreted in accordance with English Law except for its conflict of law rules.

    If you reside elsewhere, this Agreement is governed by, construed and interpreted in accordance with the laws of the State of California except for its conflict of law rules. If you are a resident of the United States, any Dispute not subject to arbitration and not initiated in small claims court must be litigated in a court of competent jurisdiction in either the Superior Court for the State of California in the County of San Mateo or in the United States District Court for the Northern District of California.

    10. GENERAL LEGAL

    You are bound by this Agreement’s most current version. SCE may modify this Agreement’s terms at any time. To access a printable, current version of this Agreement, go to http://www.scei.co.jp/psvita-eula. Please check this URL from time to time for changes to this Agreement. Your continued access to or use of System Software will signify your acceptance of the latest version of this Agreement.

    If any provision of this Agreement is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement are not affected or impaired in any way. You acknowledge that your breach of this Agreement would cause irreparable injury to SCE for which monetary damages would not be an adequate remedy and that SCE is entitled to equitable relief in addition to any other remedies it may have under law.

    This Agreement constitutes the entire agreement between you and SCE with respect to System Software and supersedes all prior or contemporaneous understandings regarding its subject matter. No failure to exercise and no delay in exercising any right under this Agreement operates as a waiver of that right. SCE may assign any of its rights under this Agreement, including its rights to enforce this Agreement’s terms to any SCE affiliate.

    It has been a while since i update my PS3 history on this site, so instead of rehashing the same old thread, i thought i would make a new post, to get those acquainted with the history that is the PS3:

    2000-2001

    These years may seem early for a story on the History Of The PS3, but these dates will be understood as you read further into the PS3 history.(Thanks to winocm, for making me go back this far :p).

    During the year 2000, Sony Computer Entertainment, Toshiba, and IBM(STI),formed an alliance, an alliance that would see the creation of the Cell Processor, Cell is short for Cell Broadband Engine Architecture.

    March 2001
    The STI design center opens and begins production of the Cell processor, this would be a four year endeavor, which would lead you to 2005.

    ThatOtherPerson, the guy that makes various PS3 mini-homebrew games has released and updated the source code(s) for all his PS3 homebrew projects at his blog.  He also goes on stating that he will be taking a break from the PS3 for a bit and return back to making homebrew for the Wii.

    To quote:

    The REBUG team never disappoint the scene and this time they’ve introduced what they call “Toggle QA”. This package basically allows you to SET/RESET your QA Flag.

    *** THIS SOFTWARE WRITES TO THE PS3 EEPROM – USE AT YOUR OWN RISK ****

    After having to QA a few PS3 in a row. Then installing a different firmware straight after, it was time to cut out the middleman.

    Toggle QA will SET/RESET the QA Flag and Token on any 3.41 or 3.55 firmware that has lv1 mmap and lv2 peek and poke patches (which is most of them).

    When you run the app it first detects if the PS3 is 3.41 or 3.55. Next it will check if your firmware has any of the required lv1 patches already and only patch the hypervisor with the ones you need. After it finishes patching Toggle QA will check the status of the QA Flag and SET/RESET it accordingly. Then once the QA SET/RESET is done any lv1 patches made will be removed.

    HOW TO USE:
    1: Install toggle_qa.pkg
    2: Run Toggle QA from XMB
    3: PS3 will beep and return to XMB. (If you do not hear a beep it has not worked)

    NOTE: Every now and then it will hang on the lv1 patching stage. If it has not beeped and returned to the XMB after about 30secs you will need to reboot and try again.

    How to use:

    1. Start bat file YABStart

    2. Set up on PS3/Proxy Seetings IP: of your computer

    3. Set up on PS3/Proxy Seetings Port: 27 u can change them on config folder (port.txt)

    4. Connect on PSN

    Succesfully bypassed 4.00 on 3.72/3.73

    NOTE:

    -If you want turn off proxy, you must do it on your TASK MANAGER (CTRL + ALT + Delete). Search process PS3YAB.exe.

    -No It no gain you PSN on CFW.

    You can download all stuff from PSStore without error.

    I had just posted here a few days ago about the OtherOS case, well unfortunately, Sony’s request for dismissal has been granted, here is a quote of some of the court case.

    The flaw in plaintiffs’ analogy is that they are claiming rights not only with respect to the
    features of the PS3 product, but also to have ongoing access to an internet service offered by Sony,
    the PSN. A somewhat fanciful, but more apt, analogy would be if Toyota sold hybrid vehicles with
    an advertisement campaign touting that Toyota owners would have access to a recreational driving
    facility, a no-speed limit amusement park for cars. Then, at some time thereafter, Toyota instituted
    a rule that its hybrids would not be permitted in the park unless the owners allowed the battery
    feature to be disabled. In those circumstances, Toyota hybrid owners who declined to authorize
    disabling of the battery feature would still have fully-functional hybrid vehicles, capable of running
    on an electric motor or a gasoline engine, as appropriate under the conditions. Similarly, PS3
    owners who declined to install Firmware Update 3.21 still have fully-functioning devices, capable
    of either being used as game consoles to play games on optical disks, or as computers, with the
    Other OS feature.
    While plaintiffs would characterize the ability to access the PSN as a “fundamental feature”
    of the PS3 itself, it cannot be disputed that the “feature” is dependent on something outside the
    actual device—i.e., the continued existence of the PSN. Additionally, plaintiffs acknowledge that
    installation of Firmware Update 3.21 was entirely at the discretion of the user; indeed they have
    proposed separate subclasses for those who did chose to download it and those who did not. The
    choice may have been a difficult one for those who valued both the Other OS feature and access to
    the PSN, but it was still a choice.
    Under these circumstances, it cannot be said that Sony “unilaterally took away a
    fundamental feature of a product after that product [was] sold to a consumer.” Rather, Sony
    unilaterally imposed a requirement that PS3 owners who wanted continued access to the PSN
    service would have to allow the Other OS feature in their machines to be disabled. As a
    consequence, for Sony’s conduct to have been in any manner wrongful, it is not enough for
    plaintiffs to show that they have a right to expect continued availability of the Other OS feature
    beyond the warranty period, but also a right to continued access to the PSN.
    Nothing in plaintiffs’ factual allegations or their arguments is sufficient to support a
    conclusion that Sony has any obligation to maintain the PSN in operation indefinitely. Had Sony
    elected to shut down the PSN entirely, and for some unknown reason then offered PS3 owners the
    option to disable the Other OS feature on their machines, users who elected to do so would plainly
    have no claim for loss of the OS Feature.1 Nor would it be sufficient for plaintiffs merely to say
    that, having elected not to shut down the PSN entirely, Sony had no right to limit access to the
    service to those who agreed to disable the Other OS feature. This is not a discrimination case, and
    nothing in plaintiffs’ factual allegations supports the existence of a legally enforceable duty on
    Sony’s part to refrain from altering the conditions under which users are permitted access to the
    PSN.

    It ends by saying:

    The dismay and frustration at least some PS3 owners likely experienced when Sony made
    the decision to limit access to the PSN service to those who were willing to disable the Other OS
    feature on their machines was no doubt genuine and understandable. As a matter of providing
    customer satisfaction and building loyalty, it may have been questionable. As a legal matter,
    however, plaintiffs have failed to allege facts or to articulate a theory on which Sony may be held
    liable. The motion to dismiss is granted, without leave to amend. The motion to strike is denied as
    moot. A separate judgment will issue.
    IT IS SO ORDERED.

    Sony is a sneaky company aren’t they? It turns out a good handful of the PS Vita’s games will require you to purchase one of Sony’s proprietary Memory Cards in order to even save the game, basically making them unplayable! Because who wants to play a game for no reason? So you can take that $249.99 price tag and raise it to about $274.98 (and that’s before tax)! And that’s if you plan to buy the “basic” version of Vita… you can expect to spend well over what you thought you’d be spending if you plan on buying the 3G version.

    These games will require a Memory Card to save your progress.

    With the high price of the PlayStation Vita’s memory stick, we take a look at whether you need the flash card to use the handheld, and what the added cost means for gamers.

    Sony’s decision to stick to a proprietary flash format was initially met by criticism due to the simple fact that gamers didn’t like the idea of purchasing yet another memory card. However, when it was revealed that the cards will cost $24.99 for a 4GB Memory Card, $39.99 for 8GB, $69.99 for 16GB and $119.99 for 32GB, Sony immediately drew flak for their incredibly steep price. In comparison, a 4GB MicroSDHC card costs as little as $4.99 and a 32GB one costs $35.99.

    As a defense, Sony stated that they wanted every Vita owner to have the same brand of memory, so it is “an even playing field” for gamers – even though load speeds on different brands of MicroSDHC cards is less than negligible. Another reason given was that it was an anti-piracy move, although it’d be naïve to think that the memory stick will manage to prevent piracy for a very long time, with most electronic devices hacked within weeks of launch. But even if you accept that milliseconds of load is important, or that the memory stick will be able to fend off pirates, neither excuse explains the price. Proprietary formats are generally more expensive due to the fact that less products are produced, but not by so much. For example, the NVG card used to store Vita retail games is also proprietary, yet must be cheap to produce, otherwise the games wouldn’t make a profit.

    The move is in direct contrast to Sony’s openness with the PS3, which is repeatedly praised for it’s ability to use any 2.5″ SATA HDD, and is actually more similar to Microsoft’s decision to charge well above average for their proprietary hard drives. But even Microsoft’s business strategy was preferable – you don’t need to own a HDD for 99% of retail games – but on the Vita, a memory card is much more important. The biggest launch title for the Vita, Uncharted: Golden Abyss, requires a memory card simply to save the game, along with several other games. That means that if you buy a normal Vita without a card, you will essentially be unable to play the game. The sad fact is that the average gamer won’t know this, and neither will gift-givers, meaning that the first emotion countless Vita owners feel when they try and play their new handheld will be anger and confusion. Especially when they realize the price of the memory stick.

    If you plan on buying a PlayStation Vita, you will have to buy a memory stick just to play all the retail games, so the true cost of the Vita is above the advertised price of $249. Sony has basically sold a car without one of the wheels, just to make it appear cheaper.

    Newest tweet from KaKaRoToKS says that his current WIP jailbreak works with PS3 FW 4.0. There is no current release date, or time frame for the JB release.

    UPDATE

    KaKaRoTo has just recently updated his blog, with this message:

    I tested the jailbreak on the latest firmware 4.0 since it was released and I can confirm that it still works. Mathieulh also confirmed that the NPDRM algo that he has still allows applications to run on 4.0, although he still doesn’t want to share that with us/me at the moment.
    Mathieulh is still thinking about whether or not to share it, so I’m hopeful he’ll help us move forward with the release.

    He has however received so many hate messages and so many flaming that he is completely disgusted with the scene and the way it treated him. He is so disgusted that he does not want to share or help anymore. He thinks that all those haters do not deserve to be given something that they are so ungrateful for, and I perfectly understand his position. Receiving all that hate towards me a while back also made me depressed to the point I stopped looking at the PS3 entirely.

    Next time you want to insult a dev, thinking it’s “fun” or that he deserved it, think about it some more, you are poisoning the scene without even realizing it. We are all doing this for fun, the only reward we get is people’s gratitude, and all you do is hate and disrespect us, so why continue to do what we do?

    For those who hate and insult : Mathieulh may not be acting the way you want him to, you may think he’s a jerk or hate him for teasing without releasing, but the simple fact remains that he has done more to the scene that you did, so you should just shut up and show him respect. When you have your little ‘hate fun’, you are actually contributing to the scene, but in the wrong way, you are killing it by killing the developer’s motivation.

    For now, Mathieulh doesn’t want to share his work with me, and I’m not mad or disappointed at all at him, I am mad and disgusted at those who made him make that decision. So please, if you are just as mad as I am, do NOT make this an opportunity to hate even more on Mathieulh for not sharing, make this an opportunity to show gratitude where it’s due and educate those who are ungrateful on what their role is/was in this scene.

    Whilst i haven’t played Skyrim on the PS3, due to wanting to keep it for PC play, i have read quite a few stories regarding problematic game play on the PS3 console, now this just isn’t restricted to Skyrim, those of you that have played Fallout 3 and Fallout New Vegas will have noticed the same type of lag, up to the point the it is so slow, it becomes unplayable or the game simply crashes.

    Now this problem and i have noticed it myself, seems to happen as the save file size increases, i think on the Fallout games it starts happening around 5MB, fixes have been released for the Fallout games, but the problems still exist and the case is no different with Skyrim, the recent patch, does not fix the problem.

    Joshua E Sawyer a developer who worked on Fallout Vegas, explains what he thinks the problem may be, here is a quote of the article, with a link to the full article below the quote:

    So what might be the problem? Seeing as the 360 doesn’t appear to manifest these issues under the same conditions, it raises the question as to why this glitch is proving to be such bugbear for Sony’s platform alone. There are certain aspects which separate the two consoles, such as the split RAM setup of the PS3, and the mandatory 4.3GB install, but neither of these differences seem to hint at an absolute explanation for the problem.
    The theory currently being proposed on the Bethesda forums is that there’s a memory leak. The idea here is that the PS3′s RAM is slowly being filled up with data during the course of play, which forces the game to stream more regularly from the HDD, causing these momentary freezes.
    Having profiled the phenomenon, we have our theories about what’s going on too. Skyrim is a game with an enormous amount of objects and characters in play. The gradually expanding size of the save game strongly suggests that it acts as a database that keeps track of how the active pool of objects, characters and other elements has altered since the game began. Perhaps after reaching a certain size, database management requires much more processing.
    Another theory concerns where Bethesda store this database. The split-pool RAM architecture on PS3 is more constrictive than it is on 360, and this is clearly a RAM-intensive game. We wonder if the save game resides in the graphics RAM instead of the XDR, which Cell addresses much more quickly. Bandwidth between the PS3 CPU and VRAM is a mere 16MB/s, compared to the 22GB/s access the 360 has to its unified 512MB of GDDR3. Advanced database management on a much larger save would have clear performance implications bearing in mind this bottleneck.

    An Unbounded Game Running on Space-Constricted Systems
    However, the most likely explanation is that an advanced Skyrim gameplay state – like the 65 hour one we tested – proves to be too much for the garbage collector, or memory defragmention method, struggling to cope with the multitude of gameplay elements that have been altered from the default “virgin” state stored on the hard drive. To test the possibility of this, we tried loading our 65 hour save and playing with it for 30 minutes, and then directly loading our new character save from the menu – the result being that the stuttering does indeed carry straight over to our virgin save. It suggests that memory has been allocated that the garbage collector cannot reclaim, which isn’t flushed when the player returns to the menu screen and starts the game anew.
    The bottom line is that Skyrim is an unbounded game world running on a space-constricted system – and this applies regardless of the platform you play it on, hence reports of the PC version running out of address space and displaying solid colours instead of textures. The PlayStation 3 is unfortunate in that it’s the platform with the most oppressive RAM issues (in addition to the split-pool set-up of the memory, the OS has a larger footprint than its 360 equivalent) so it makes sense that it has the most noticeable issues. But we do have to wonder how 360 owners with a 65 hour-plus save are coping, and whether the same issue manifests for them – just further along in the gameplay. If any 360 owner has a similarly mammoth save, please get in touch.

    From reading that, it is obvious, that Bethesda knew of the problem and it seems without a complete re haul of the code, PS3 players will be out of luck.

    Just recently Bethesda has posted on their website regarding the PS3 Problem:

    While the 1.2 update fixed the long-term play issues for most PS3 users, we are aware that is not the case for some. We’ve been reaching out to a number of those users to collect save games, so we can take a look at their specific issues. Right now we know it’s not one thing, but a combination of smaller ones that some folks are seeing, but others are not. Some seem to be the PS3 autosaving in the background (you can turn that off), some may be SPU AI updates, and some may relate to dynamic system memory allocation. These fixes are not in the current 1.3 update that is in final testing, but will be in future ones. We understand how frustrating it can be when your game is having issues, and we thank all of you for your continued feedback and patience. Rest assured we take your gameplay experience seriously and will continue working on this until it’s resolved.

    UPDATE 2

    Bethesda has posted a few fixes on their forum, to help alleviate problems.

    As we continue to work on updates for PS3 (as well as Xbox 360 and PC), here are some helpful pointers that can help the game’s performance.

    Turn off auto saves. This can cause temporary stuttering since the PS3 saves these files in the background. This is most noticeable with large saves when fast traveling to a new area or entering a new area that auto saves.

    Clear space on your hard drive. Skyrim makes heavy use of the hard drive, and freeing up space on here seems to help many people. Hard drive speeds also differ in PS3 models. Some users have reported increase performance by upgrading their drives.

    Waiting for time to pass. Many things are running in the world depending on what quests you’ve done or places you have visited. Using Wait or Rest options, passing time will clear up some of these. It depends how long you wait, it may take up to 30 days for some items. Saving, resetting, and loading after this will have the largest effect.

    We’re receiving positive feedback from folks that are clearing hard drive space. We’re looking into this further, but if having at least 2 GB of free space will help the system memory work with the PlayStation 3 hard drive more effectively. If you can free up more space than that, it’s possible you’ll have better results.

    In addition, the PS3’s Safe Mode* feature includes options that can help with memory fragmentation.

    Restore File System. Attempts to repair all areas on the hard disk drive where files can be saved. Corrupted data may be erased, which can help performance.

    If you choose not to enter Safe Mode, you can manually delete corrupted saves within the XMB menu. Go to Games>Saved Game Utility. Within the menu, delete any corrupted save files. These files can be created from Skyrim and other games when a game doesn’t save properly (shutting down the console before an autosave completes, etc).

    Rebuild Database. Will help with memory fragmentation on the PS3 HDD. Note: Using Rebuild Database will erase messages, playlists, changes made on [Information] screens, trimming information for pictures in [Photo], video thumbnails, video playback history and video resume information. The content that is erased will not be recoverable.

    *Sony does not recommend using the options in Safe Mode unless you are experiencing issues with the PlayStation 3. Some of these options could result in loss of data.

    It has been quite a while since we spoke of the OtherOS lawsuit, i wrote here of how Sony were planing to dismiss the case, then in July 2011 the court case continued, with that hearing just recently being brought to light by the awesome Groklaw,here is a part of that hearing:

    THE COURT:
    – the big difference between the last complaint and this one, in terms of an item that is being
    presented as a basis for these claims, particularly the express warranty claim, is the statements by Mr. — I think his name is
    “Harai” — about the life cycle, if you will, of the PS3. And I suppose my question is: Aren’t you expecting
    that statement to carry an awful lot of water here, in terms of providing any kind of warranty that the Other OS function is
    going to be maintained in seeming perpetuity, and in no way will be affected going forward; at least, with respect to this ten-year period that you’re identifying? It’s a very general statement about the market cycle of a product. And to transform that into the flagship of your warranty claim seems
    to be expecting a lot out of that statement.

    MR. QUADRA:
    Well, your Honor, let me at least clarify one point. Our allegation is not that it is a market-cycle statement; that, in fact, it refers to the life of
    the product, itself. When it was first made, that specific statement in its entirety, which I believe — the defense counsel sort of cut part of the quote — goes on to say that they’re not envisioning putting out a new product, because they purposely make their products to last this period of time.

    Im sure there are those of you that updated to the new 4.0 OFW that Sony released last week, you needn’t worry as you will be able to downgrade, which has been confirmed by various people/devs including DiGiTaLAnGeL from digitalangel.it, it should be safe to say that all future firmwares will be downgrade able, but its still always better to have confirmation.

    BTW, this is the device you should be buying instead of that junk True Blue, with Progskeet, you can downgrade to CFW, for backups and Homebrew, then update to play online and download PSN games, then downgrade back to CFW :)
