Has anyone notice that Sony is only going after anything that says PS whatever? if those tools did not say or have anything to do with the name PS3 or PS anything, Sony would be hard pressed to know which files they would have to look for in order to take them down. change the names and sony's argument is rendered useless.

I so agree with this statement. From the PC to the mac to even iphones, we have made it our right to customize what we own. We bought it. Legally, it's ours to control. At the time of purchase from whatever store you purchased the PS3 from, there was no disclaimer read to us that this is a leased gaming system. Nowhere on the box does it tell you that.
I can understand if Sony's argument is about protecting their network from cheaters. i can also understand protecting the intellectual property of the Game developers and publishers. However, we know that's not their focus because if it were such, they would be going after torrent sites that allow people to download games and as such, pirate. You can't put a band aid on a open, bleeding wound and expect it to heal.
I've heard fanboys on the PS blog say it's great that Sony is going after the hackers. I feel that these people have no clue as to what the real premise of why developers do what they do. It's not to hurt the video game industry. they didn't make these tools for the intent of piracy. they simply just wanted to customize their property.
Sony is mad because what they valued as "unbreakable" was just broken and to Quote from someone else on this forum "pandora left the box open and it will never be closed". it's just like the BP oil spill. you may get the oil off the water's surface, but it's still coats the ocean floor. How are you going to clean that up?
I wonder did Sony noticed the number of Ps3's being sold from the time of the JB to now?
