On the whole however, the case was weak regardless, Sony offered the feature and they do not force people to update their consoles at gunpoint, it is a choice the owner makes.
If a hacker figured out a way to break the bluray playback on a million bluray players and went through with the attack, that hacker would face serious fines and/or jail time. Sony does the same thing (plus more) and gets away with it. You don't need a gun to commit theft.
