True, but you can still mod the hardware without being liable if you do not accept. So then when you release hardware chips and whatnot Sony can go and screw themselves since you never agreed to their terms. Difficult to do without testing.

Still though, Sony has no right over the consoles hardware after it is sold. So you can legally modify it if you want to. That clause is meant to try and screw the customer out of a consumer right... Which should not hold up in a court of law in the US... Should not, but a company with a lot of cash....

If Sony incapacitates your console after you hack it, they will have a lawsuit on their hands they may not be able to win. It is illegal for them to make your console inoperable. Take a look at MS and what they got into after they not only banned, but crippled hacked consoles. They uncrippled the consoles with the next update. They have the right to disallow access to PSN, but they cannot harm your property, or at least should not be able to.
