what's also nice about the ps3 is the backward compatibility.. seeing as most of the games are easier to find on ps2, opposed to xbox which are limited to find.

You can ALWAYS get caught, if you're stupid enough to GET caught.
If you play a bad burn of a game (even offline) you can flag your console, and the next time you go online, you get flagged on the network side of things. Then your console is ****ed.
The profile you play on is irrelevant as it's the console itself which gets banned, not the profile. There is no reversal for this, shy of getting the KV from another console which is not banned, which requires an unbanned console anyway, and thus is kind of dumb to do.
I have and still do play some backups online, and have not been banned yet.
As for PS3, it is WAY harder to get a backwards compatible PS3 than a backwards compatible Xbox360, as only launch PS3's were backwards compatible with PS2 games, although they all play PS1 games. With Xbox360s, AFAIK, you just need to put in an Xbox1 game, and connect to Live. It'll say you need to download the files for backward compatibility to become active, so do it, and it'll run over 200 Xbox1 titles, no problem.
