Sorry samson, i dindt answered you, but i had not much to say, when i tryed this "XMB background music" i think it was with a homebrew (i used to make test with simple and little ones for easy uninstalls if something get corrupted)
For me it worked at first try, but i had no idea of this problem with the SDK, try what ada said by changing the PS3_SYSTEM_VER (i used to change them to something bigger like 3.41 and never saw a problem with it)
Its supposed to be a function in the firmware and not in the game itself, but lets see, maybe there is something missing in the EBOOT.BIN

Edit: remember, after replacing the PARAM.SFO you need to boot the game 2 times to "refresh" the XMB (trick explained before in one of my walls of text), if you dont boot it 2 times the XMB will keep loading the old one because are stored duplicated
The other option to "refresh" XMB is by using "rebuild database" from the recovery menu <--- boring

Edit2: advanced hint
When playing with content that is not BOOTABLE (e.g. with a patch) obviously you cant refresh the XMB by booting it two times, heheh
This is when the option "rebuild database" from the recovery menu is usefull

-Both contains a "savedata" folder (with 2 blank memory cards) that is part of the game files, and not to store save games, used as a "source" to generate game saves
-Both stores save games in internall virtual memory cards

-The format to export PS1 to PSP is inherited from PSP, but PS2 doesnt use this format because PSP cant boot PS2 games
-The param.sfo generated when exporting PS1 to PSP doesnt have this "black area" out of his estructure (the PS2 exported to USB have it)
-PS1 exported to USB is an "slot"... but PS2 exported to USB is a folder with 2 memory cards

Resume: they are reciling formats and/or improving them (maybe preparing PS2 support for vita in a long term?)
The tool i found to manage the 3 formats used by PS1 (VM1, PSV, VMP) is a bit obsolete, but can be used to play a bit with PS1 savegames (at least to take a look at them), and even with a hexeditor there are identifiers that can be seen
