not quite true otherwise all providers of free wifi / internet cafes would also be responsible for anything another did on their conection leaving the guilty party in the clear but as has happened in the past, many things happen on these networks where the owner is not charged.
at home, you are responsible when you allow someone access. unauthorised access, whether its open or not is not your responsibility. for it to work, securing the connection must be a legal obligation and not an option
