The SDK does work but requires some brains and setting up...

I have successfully compiled + ran a few samples and am working on writing tutorials for the newbies.

.. so is smoking the green stuff in your oversized novelty signature :aetsch:

Now that it is spread over public bittorrent, Sony is going to have a hard time stopping and tracking the thousands of users that are already downloading it at this second, and really their (3 year old) SDK I wouldn't think is their worst nightmare. It's not like users can build commercial software that will run on a non-hacked PS3. It's a niche thing. They have more reason to stop the sale of the chips that allow the hacking of the console in the first place, which they've already / are already doing.

People share Microsoft software, Adobe Software, Maya and everything else worth thousands of dollars all over the Internet all of the time and the prosecution vs distribution rate is tiny.

For the large majority that just want to play commercial games, they'll already be on 3.42 already, and still buying games just like they always have. The small minority that wants to compile and run their own homebrew stuck on 3.41 forever are hardly going to be cutting into the revenue stream of the development studios with millions of $ behind them.

I see it panning out a bit like the old Xbox scene, where people freely distributed the source code for homebrew (such as XBMC). Distributing your own programmed source code isn't illegal, as long as you don't distribute any of the libraries (which come in the SDK). Then users can just compile it themselves using the SDK, to run on their own PS3.. and of course there will be compiled copies around distributed underground, just like any other software.

Over time there may be open source compilers and libraries so that even binaries can be more freely distributed... but getting the commercial SDK is an interim step.
