Ok, i have set up my headset, but in game i hear nothing. I hold down L3 and talk but no one responds? Is the problem me or has it just been the servers or people?

Also, sometimes my headset will randomly go into standby (a led light every 5 seconds) , how can i stop this?

First thing is first, are you sure you have it set up correctly on the ps3, go to your audio settings and try that out first.
