Doesn't the game have a disclaimer regarding seizures on startup? I'm not sure if he'll win this case.

I think all games have that seizure warnings, the guy is probably just throwing a lawsuit hoping he will win.

If someone is to blame, it isn't Sony's fault as the game was released on the PC and X360.

It should state it before you actually open it, and I have just looked at 3 of my games and not one of them says the standard epilepsy warning on the case. (Should, not has to)

It's another indication that the powers that be do not differentiate between a TV program which only has to display it at start of program, and a DVD or Game that realistically should make it known prior to purchase. I think he has a good point, although I would have thought that epilepsy checks were a standard and regular thing to be a pilot?

It isn't really Sony's fault though, but he may get compensation from the health and safety bodies and all future games will have to display it on the case?

He claims this is his first seizure ever. If that is true, I'm very glad he got it from a video game, and not while FLYING AN F-18.

Even if he hadn't broken a bone, the fact that he is now known to be prone to seizures disqualifies him from flight. That had to be preexisting; The game didn't cause him to suddenly be prone to seizures.

F-18 pilots are chosen because they have perfect vision, perfect this, that, everything. It's the cream of the crop, and if he had been listed as prone to seizures, he'd never been allowed to go to flight school. The game did him a favor, possibly saved his life later on. While it sucks, it's necessary.

If he's suing because he lost his job over the seizure, that's ridiculous. Preexisting condition that was unknown, i.e. the game didn't cause him to lose his job, the game making his condition aware did. It would most likely happen sooner or later. So he can only sue them for the seizure itself, not the loss of employment in this case, I would think. And even then, yes they should possibly mark the box for seizure, but basically EVERY video game could cause a seizure these days depending upon how sensitive you are to them. And they do have warnings at the beginning, so I doubt he wins this. It's just a sad case where he didn't know he might have seizures, anyone who regularly/sometimes has them is aware and takes precautions and heeds the warnings.

How stupid can somebody be, if you sue sony for this bull**** you must be completely retarded. On the startup is always an warning message.
