So if someone creates firmware independent of $ony's code (as in completely original and all that jazz) then we could literally do what we want with it.
I'm not saying it would be easy (or even definitely possible) but it would remove the legal issues of jailbreaking. Then the only way you could be charged with anything is if they were to actually outright say "you DO NOT own your console"
Piracy would be a whole other matter but let's not get into that...

An example of the above scenario would be the star wars galaxy server emulator project from a few years ago. It was completely legal because all code was original. Whether or not your purchased the game was your responsibility.
The same COULD apply with this ruling I believe.
