well someone on the official boards talked to support. they confirm they are not banning anyone and it is a server issue.

Could the fact that people are playing the BLES version in the US be part of the problem? Fifa 13 doesn't allow you to use the BLES copy online in the US. EA gives me an error when I try to log in.
Probably not the issue at hand, but figured I'd throw it out there while I'm not playing Black Ops. |

sorry to burst peoples bubbles but yes they are banning. Both ofw users with black ops2 and cfw users with the backup. my friend used the rogero cfw with a backup of black ops 2 and was banned, i came back from vacation over seas to the us with a black ops 2 that i purchased over there and played it on my ofw ps3 and neither my ps3 or account was used on a cfw ps3, and i got the error after i played online for a few hours and now when trying to login to psn i get a ban message. they are banning people for logging in with cfw ps3's and banning for playing black ops 2 early as i have called up both activision and sony to confirm the message i recieved on my screen. sony just recently did a server update that detects cfw which = ban. activisions black ops 2 servers report you as hacking if you play the game early online = ban. sorry but its the truth

Could be more of a server issues as others have stated, as there is an issues with the pc version of the game getting the same error:
