I'd like to suggest that when someone is banned, they explain what was being done:
- Playing a certain game;
- using multiman;
- was home brew used in last place before login into;
- what cfw version,
etc

When 3.56 was released I started to play with f&@kpsn and logged as spoofed version. During my tests I tried to log again with 3.55 - Sony detected versions going up and down and sent me a warning...

Any of those acts are NOT legal.
The difference is that it is only a crime if you sell-it but it is still NOT legal to download.
The only exception is for you doing a backup copy of a piece of software you are entitled to use (a game you have bought).

I spend about 5000 euro on ps3 hardware and games last 5.5 years and start in august 2012 with cfw.

In Portugal AFAIK those laws was subject to change.
So in some sense he is right about that, it's legal if you download and keep it. It's not legal if you sell what you downloaded.
So they can (anyone correct me if my statement if wrong, any Portuguese user) download copyrighted material for personal use only with nothing to be afraid of but if they want to start some business with that = ****ed.

Like i said i will not generalize, it's your opinion and i respect it but i beg to differ.
If you tell me about *old school* cfw users (before this all 4.3x and the keys appeared out of the blue) wanted all the time play for free, dev's will not wasted their time coding apps to use on brews'.

Sounds logical to me.
Or you can refute with solid facts that MOST of the APPS that get frontpaged ONLY triggers *warez*?.
We have a solid foundation called ps3devwiki dedicated to study each part of the PS3 system, we have a homebrew site also that don't host warez files.

It's up to the end of user but saying *most of them want to play for free* it's a little bit too much for my taste.

Now if you tell me that when DRM devices (one specific that WAS blue) were on the market and many people was buying that. I could partially agree with you on some point.
Because by buying that device you were *buying your freedom to play for free* (ironic).
But those who purchased DRM devices is pretty obvious that the intention behind that purchase WAS NOT to use brew's. *Just play for free* as you stated.

I don't know if it's a ban hammer *syndrome* since some user said here something that true, if the ban hammer is ON they will not focus only on CFW'S users they will ban civvies as well (OFW'S).
I don't know either which criteria they use to ban (As you seen) they don't even specify some solid reason why you got banned either.

Personally i don't think (today due to recent events) going online spoofing your mac and console ID is near safe or 100% safe even with mM stealth on.

Actually giving a second tought to this i read it all over the place that each time you log into PSN with mM (before the creator of this app released the MASK option) mM was giving away your *position* for some happy trigger sony's employee to have fun. (and im not blaming mM so please read carefully)

I don't think is safe at all for a cfw user to go online if that user has ONE ps3 and don't want to end banned or is scared about get hammered.
That's why many users (that can afford a second PS3 even a used one) they have one for OFW and another for CFW and that way the can enjoy both of those worlds without too much risks involved.

Yes, you can try but i can't guarantee any difference IF something happens.
It's not like the mac address of your PC where if you got banned from some site or irc. You can change it as many times you want and still get access. (Vpn, etc)

Im offline with a friend's PS3 that has CFW since all this happened. (Call of rope 2 bans).

Best advice i can give, stay offline if you have something to lose. If you don't just keep going online.

everything is kool and the gang with 4.21 rebug rex so far just logged in not running stealth play a little on psn nothing to crazy and sign in for youtube mostly...

The netflix app is designed to allow you to access netflix in the event of a psn outage. So if you simulate an outage then you can still use netflix with a banned console.
