Any PS3 slim 120gb or 250gb that is brand new and hasn't been tampered with will be on a firmware on or below 3.55. The problem is finding one that is genuinely new. Can't find much 250gb wise that I would trust. Lots of genuine brand new 120gb models still being sold at Asda Direct, only useful if you live in the UK tho lol. If you're not sure it is brand new then you really do have to ask the seller what firmware it is on.
