it is my good faith belief that none of the code at hermesEOL/fail0verflow (see reference below) infringes on Sony's copyrights, and that their takedown notice is in error. further, Sony is attempting to abuse the DMCA to avoid public embarrassment (too late) and put the genie back in the bottle (too late), and has failed to meet the minimum requirements for giving DMCA notice (no details provided on which source code lines infringe copyright). the exposure of sloppy crypto implementation on Sony's part in no way infringes on copyright or makes available any of their proprietary internal software; the repository in question contains exclusively original third-party code that does not directly facilitate infringement.

please restore public access to the source repository in question. this shall serve as my electronic signature.

thanks, Scott Francis 3029 Adirondack Court Westlake Village, CA 91362 805-491-4575

As you can see in above text it seems that some people are of the opinion that of sony is failing to meet requirements of DMCA laws,I just wonder if there is any truth is what this guy is saying?. only time will tell, This may mean sony have no chance in hell of winning their legal battle as its there own code that has put them in the postion they are in now .

Have your say on this below

I would love to see more things like this happening. Sony needs to know that they cannot bully the world into hiding their mistakes.

You do not control the internet Sony.

You do not own our hardware Sony.

Leave us alone!

Uhhh...what? Is this the editorial opinion section?

Why is someone's opinion front page news?

Sony will have a say and the courts will continue for one reason. Money. Sony has a lot of it, and it all goes to lawyers and courts whom all want money. The courts and even Sony's lawyers I bet don't care if they actually win, they just want a piece of Sony's billions and who can blame them?

A good non-corrupt *good luck* lawyer would be needed to fight these issues, and not following DMCA rules is not one of them. At that point Sony lawyers would argue its more of a guideline than an actual law, that allows legal action when infringement is in question, and considering their current case with Geo, chances are there's enough doubt on infringement to act on the DMCA to nab the others with little to no notice.

Either way time will tell what happens.

Thumbs down Sony sux

HEY SONY its called FREEDOM OF SPEECH if a person wants to print something on the internet they have all the right in the world to do so and SONY does NOT have a right to say otherwise and the only thing they can do is whine and cry because SONY is nothing more than a GREEDY COMPANY that cares nothing about their customers so keep fighting for our right to choose what WE want and not what SONY wants.

This reminds me of what happened to bleem! LLC. when they fought Sony. Even though bleem! won in court, they went bankrupt. Let's hope we don't get to see the people involved losing a lot of money because of this.

It's no good PR for sony to sue everyone, Nintendo and Microsoft know how to treat their customers.

The people that are getting sued are customers. Like you and me, and I would hate to be served because of researching a console I bought.

Sorry if I state a lot of obvious stuff, but I hate to see what Sony is doing.

Anybody give me the link showing what specific parts of the DMCA Sony are citing as pertinent please?

I am trawling through the DMCA now and so far I have found quite a few entries that lean against Sony rather than for, but the specifics are needed really...

Power to the people!

This is what I've been demanding from everyone for a while. We've violated no copyright laws, it's not our fault Sony botched their code...We need to force our government to enforce our laws in our favor, not big companies...Communism is evil when its used in this manner...

Sony can't stop us or stomp our rights!

Sorry, but from what I am discovering, it truly does seem that if you are in US you have much less rights. In UK there have been cases where a discounted refund was given because Sony removed OS from the PS3 for example, as when purchased it was advertised with OS included. Amazon were legally oblidged to issue the refund btw, not Sony, and then Amazon claimed from Sony direct.

This by all apparent information could not happen in the US as the laws there have been circumvented by the Federal courts for one.
