As much as this law sue is beyond stupid, I'm not sure Sony doesn't give this guy money and settle out of court. At this point with the hackings Sonys rep public wise is very poor. To get sued by a US Navy pilot at this point isn't good no matter how right they may be.

The lawyer has no case. This dick bag had a "grand mal seizure" which is also known as a tonic-clonic type of seizure. They can be caused by epilepsy but it isn't always the case. He claims he saw flashing lights in the game before this happened, but it doesn't prove he had a seizure as a result of epilepsy. He'd have to get tested medically first to prove he even has epilepsy. Then he can go to court and get his case thrown out because THE BOX HAS A DISCLAMER. It's been like this on almost all video games since the dawn of time. He's wasting his time. Game Over.

He should sue the military for discriminating against him for having a medical condition. They did not fire him for a broken bone; jet pilots get broken bones and go back to work when they are healed...he was fired for a physical disability...and he could sue for that. Of course, he probably LIED on his applications, and never should have been accepted in the first place, in which case, he should owe the government the ~$1,000,000 it cost to train him.

Sorry Mr Pilot guy, this will never work. You may be able to get a settlement out of Bethesda and/or Sony, but it will be because they don't want this causing publicity. But, every game has a warning about Seizures on the back cover. The PS3 has a warning in the owners manual. MGS4 even warns you during loading screens.

I currently hate Sony, but there is no way they can be held liable for a medical condition you didn't know you had.

I will say, good timing for your attempt. Since Sony is in public heat right now, you might get them to bend on a settlement.

I'm a medical student and I want to say that, if you have one epileptic seizure that doesn't mean you have epilepsy. First of all, you have to have seizures since early childhood or since you were a teenager. Second of all the guy is a fighter pilot, that plays oblivion - he gets exausted, alot! Exaustion is one of the things that can cause an epileptic seizure in any one of us! It won't hold up in court!
