Depends on who you ask. If you ask $ony, they'll tell you that buying a used game from game stop is piracy at it's worse. That's why they're pushing for the success of online gaming so that all future games will have to be activated online and can't be used on another console. If you ask the FBI they'll tell you than ANY unauthorized reproduction is piracy. What we know is that it's legal to make a back up of property you own. I would say it's piracy. And that's coming from the Captain of the Seas.

there are plenty of places from where you can buy all the top games and they are just a click away. You can even find deals where you don't even have to pay shipping.
Just out of curiosity, howcome aren't you able to use your credit card?

That is somewhat of a "grey area".

But what about a scratched game (=broken) or a music cd or whatever. In my opinion, you should be able to return it and buy a new one at the production cost of the game since you already paid for the copyrights...

multiplatform games should be similar. But this is much harder to "enforce" since you don't return your original copy and you could give it to a friend or something.

I have RDR on Xbox 360 and PS3, both authentic copies so how would it be piracy?

everybody at some time has breached copyright rules....if jesus christ was to rise again even he would find it hard to live by the strict copyright rules...and he would be cast down into hell like all the rest of us dirty little sinners.

you didnt pay for the copyright though.
you payed for the physical media which has code on it.
if you owned the copyright then you would be free to copy and resell the copies as often as you liked.
as you purchased the disc it is up to you to look after the physical state of it

some places offer a replacement policy. lucasarts is one of them
