Why would Duplex care at all when to release it? The game has already been leaked. They're a scene group, not a publisher.

the "scene" has rules that every "scene" group has to follow to release stuff and be considered as scene, the leaked version is P2P... so, no scene release for MW3 yet.

I have never heard of these so called rules. I also see no point in holding back a patch. Whether or not the game was released by the scene or not, I do not see how it affects a simple patch release.
