what i dont get is, how can u accept there agreement before u buy it , its not like the shop going to says b4 u buy this read this its from sony, then after do u still want it !. they sell with out saying anythink .so how can it stand . u cant return it if its in good working order

"2. RESTRICTIONS You may not lease, rent, sublicense, publish, modify, patch, adapt or translate System Software. You may not reverse engineer, decompile or disassemble System Software, create System Software derivative works, or attempt to create System Software source code from its object code. You may not (i) use any unauthorized, illegal, counterfeit or modified hardware or software with System Software; (ii) use tools to bypass, disable or circumvent any PS Vita encryption, security or authentication mechanism;(iii) re-install earlier versions of the System Software (“downgrading”), (iv) violate any laws, regulations or statutes or rights of SCE or third parties in connection with your access to or use of System Software; (v) use any hardware or software to cause System Software to accept or use unauthorized, illegal or pirated software or hardware; (vi) obtain System Software in any manner other than through SCE's authorized distribution methods; or (vii) exploit System Software in any manner other than to use it with your PS Vita according to the accompanying documentation and with authorized software or hardware, including use of System Software to design, develop, update or distribute unauthorized software or hardware for use in connection with the PS Vita. These restrictions will be construed to apply to the greatest extent permitted by the law in your jurisdiction." I do not know about the rest of the world, but in UK you Are within your rights to buy it and then if you do not agree to the terms return it with a full refund (although they store will argue the toss BIG style lol) The bad thing though is that if this and similar by either Sony or others becomes the norm without too much questioning and returns as I mentioned then by default it will become acceptable ![]() I am by no means a legal person, and I could be wrong, but I have had enough toe to toe 'arguments' with store people to be reasonably sure I am right with regard to UK rules on this. |

is there a law stating how many days after you buy somethink you got to look at there t.o.c if not then hyperspecal speaking ( cant spell it ) u could return it after a year and say u just looked at the t.o.c and u dont agree to it and u want a refund . or couldnt that happen ?

You get a bit of leeway at this time of year, but typically with electrical goods, it is taken as read that you will have opened it within a couple of days anyways. Like I said, I am no master on all this though, just have a bit of experience in it and always make sure I have a print out of both the legal rules and the in-store rules if I have a problem lol. One of the best and easiest reasons to cite is that what you bought "Is not fit for purpose" and this most likely would apply here as well, especially if there was a piece of homebrew you wanted to run on it and that was your main reason for buying it, as you were not made aware of their rules not allowing that until you opened it (as long as you had no intention of profiting from said homebrew). |

We don't own what we buy and they can sue us but we can't sue them. Sounds like standard Sony rubbish. Automatic updates? That sucks but I'm more interested in 6 where it says, "If SCE determines that you have violated this Agreement's terms, SCE may itself or may procure the taking of any action to protect its interests such as disabling access to or use of some or all System Software, termination of your access to PlayStation®Network, denial of any warranty, repair or other services provided for your PS Vita, implementation of upgrades or devices intended to discontinue unauthorized use, or reliance on any other remedial efforts as reasonably necessary to prevent the use of modified or unpermitted use of System Software."
So they are now thinking of implementing "devices" to stop unauthorized use? What do you suppose this means? What kind of device?

TL;DR most of it. But....
Hahahahaha. Sony is retarded. Hardware modifications are legal since, after you buy the console, it is within your rights to modify the hardware in whatever fashion it is that you see fit. It may not be legal for you to do it for another person per se, but it is legal to take it apart and mod it for yourself. There agreements have been overturned by courts when they include clauses that go against consumer rights.
