    Bad news for Geohot as Sony has been granted a Temporary Restraining Order for Geohot. It has also been ruled that Sony has enough reason to keep the court case in San Fransisco. PSX-Scene has gotten the court documents below:

    The Geohot vs Sony case is still ongoing and more drama has unfolded for you. Sony has made allegations that GeoHot’s actually owns a PSN name known as “Geo1Hotz” (thereby violating PSN ToS), but Geohots lawyers disagree and are calling for a dismissal of case all together. Now it could be very true that Sony may have created a fake account to “frame” Geohot (just like the donation trick they pulled), but looks like time will tell. (more…)

    Geohot has updated his website with a Supplemental TRO. It outlines various reasons for why geohot can still be tried within the California jurisdiction.

    1. Purposeful Injection
    “The court’s determination that defendant has purposefully directed its activities toward California is sufficient to resolve this factor in favor of jurisdiction.” AutoDesk,2004 WL 603382 at *7 (N.D. Cal. 2004). As established above, Hotz engaged in unlawfulacts directed at SCEA in California. This factor weighs in favor of finding personal jurisdiction.

    2. Burden on Defending In This Forum
    Unless “inconvenience is so great as to constitute a deprivation of due process, it will not overcome clear justifications for the exercise of jurisdiction.” Panavision Int’l LLP,141 F. 3d at 1323; Caruth v. International Psychoanalytical Ass’n, 59 F.3d 126, 128-29(9th Cir.1995) (emphasis added). Although Hotz resides in New Jersey, any inconvenience in litigating in California certainly does not rise to the level of “any deprivation of due process.” Also, Hotz has already secured counsel in the Northern District of California.

    3. Extent of Conflict with Sovereignty of Hotz’s State
    There is no concern that this district’s exercise of jurisdiction would conflict with the sovereignty of New Jersey, where Hotz purportedly resides. See Autodesk, 2004 WL603382 at *8 (“the sovereignty barrier is not particularly high when defendant is merely from another state”); Panavision, Int’l., L.P., 141 F.3d at 1323.

    4. Forum State’s Interest
    California has a strong interest in protecting residents who have been tortuouslyinjured. Panavision Int’l., L.P, 141 F. 3d at 1324. SCEA is based in California.Therefore, this factor weighs in favor of personal jurisdiction.

    5. Effective Resolution of the Controversy
    Because SCEA is based in California, Hotz’s unlawful conduct and the resulting harm impacts SCEA here in California. And one of the other defendants, “Bushing,”resides in this district. Gilliland Decl., ¶¶ 4-5, Exhs. C, D. Moreover, much of the evidence and witnesses will likely be in California, not any other forum. Therefore, this factor weighs in favor of personal jurisdiction.

    6. Convenience and Effective Relief for Plaintiff
    The Northern District is a convenient forum for SCEA’s as its principal place of business is located here. Most of the evidence and SCEA’s witnesses are also located in this district. This factor weighs in favor of personal jurisdiction.

    7. Alternative Forum
    This factor favors personal jurisdiction in California because both SCEA and Hotz’s co-defendant Bushing are located here in the Northern District of California.Although an alternative forum would be convenient for Hotz, litigating this case in California is more practical because of the facts and parties involved. Moreover, all the other factors listed above weigh in favor of jurisdiction in this District.On balance, these factors weigh in favor of litigating SCEA’s claims in this district. Hotz cannot present a “compelling case” that this Court’s exercise of jurisdiction would be unreasonable and deprive him of due process.

    Looks like Sony’s lawyers want to get paid by keeping this court case in California.

    UPDATE:

    According to PSGroove, Geohot response is now available, you can view the response HERE. The response basically defends Geohot and claims that Sony’s actions are not justified against Geohot. Furthermore you can also see refiled documents by Sony outlining tactics similar to the PSJailbreak lawsuit (view HERE).

    Sony failed in attempts to get a restraining order on Geohot, to quote @ Geohots Blog: “ As of 2:00 PM EST, 1/14/2011, I am not subject to any TROs

    Clarification from readers over at Engadget of the judge ruling, to quote:

    Update: Looks like we jumped the gun and got the story a little wrong, but thanks to our readers we’ve discovered that the judge declined to rule on the TRO. Instead she tabled the TRO issue because she was not satisfied that the Northern District of California has jurisdiction to rule on the matter because Geohot hacked the PS3 in New Jersey.

    It was only yesterday that we reported here, that Sony was taking GeoHot and the members of fail0verflow to court, whilst it seemed some of us thought the filings were questionable, these news court papers from PSX Scene, shows in fact this is a legit case, a lot of it seems to be similar to the files that were used in the Sony Vs PS Jailbreak Case, with screen shots of various forums and websites, the most informative article being #4 PDF, which you will find in the court pack below, this file has mentioned other prominent names from the PS3 Scene.

    Well yesterday we reported to you about the BBC story and Sony denied to comment, today Sony has responded to the latest developments on the PS3 scene.

    To quote:

    Sony has said that it plans to fix recent PS3 security breaches through a series of network updates.

    Earlier this week, hackers completely tore apart the console’s few remaining lines of defence against running unauthorised code, and subsequently released the first custom PS3 firmware.

    Sony has remained quiet on the issue until now, having just told our friends at Edge: “We are aware of this, and are currently looking into it. We will fix the issues through network updates, but because this is a security issue, we are not able to provide you with any more details.”

    Hacking groups don’t believe this will be possible though, telling the BBC: “The complete console is compromised – there is no way back. The only way to fix this is to issue new hardware. Sony will have to accept this.”

    Call Sony’s bluff on their “network updates”? What do you guys think about this?

    Well over at PSX-SCENE word has it that sony have again started filling papers for the jailbreakers over the U.S duriing the christmas holiday’s hence the “scrooge”
    sony have print outs from all the forum sites regarding the jailbreak and its community Sony have not yet given up fighting the war

    Expected? Maybe, it seems that the court case that was supposed to happen ended up going in Sony’s favor, simply because the “PSJailbreakers” including PS3KEY, PS3BREAK, PSJAILBREAK did not show up to court.

    The following preliminary injunction was granted:

    On October 5, 2010, the court granted a temporary restraining order against defendants and ordered them to show cause why a preliminary injunction should not issue and why the court should not issue an order of impoundment pursuant to 17 USC §1203(b)(2). Doc #33.

    The court held a hearing on the order to show cause on October 12, 2010, and no defendant appeared.

    For the reasons explained below, plaintiff Sony Computer Entertainment America’s (“SCEA”) motion for a preliminary injunction and order of impoundment is GRANTED. SCEA and defendants Tom Nooker, Bin Le Zhong, Alex Esquivel and Fai King Fong entered into stipulated preliminary injunctions. Doc ##38, 42, 45, 47. SCEA has not moved for injunctive relief against defendants Vlad Gazoune and HuanRan Lee. The defendants bound by the this preliminary injunction are: Thahn Nguyen, individually and doing business as USATechCity, Ltd (“USATechCity”) and Arthur Bates II, individually and doing business as PSP Pit Stop (“PSP Pit Stop”).

    Having considered all the papers and arguments, the court finds that SCEA has established that it is likely to succeed on the merits of its claims for violation of the Digital Millennium Copyright Act and federal trademark law and that it will suffer irreparable harm unless defendants’ violations are enjoined. The court additionally finds that the balance of equity and interests of justice support granting such relief. Furthermore, defendants failed to appear or otherwise show cause why a preliminary injunction and order of impoundment should not issue.

    Accordingly, the court orders as follows:

    1. Defendants and their officers, employees, attorneys and representatives, and all other persons or entities in privity or acting in concert or participation with defendants, are enjoined from selling, offering for sale, marketing, advertising, promoting, installing, distributing or otherwise trafficking in circumvention devices, including but not limited to any or all of the PS3 Jailbreak devices, any copies or versions of backup manager or any other hardware or software that bypasses technological copyright protection measures in SCEA’s PlayStation®3 computer entertainment system;

    2. Defendants shall preserve all communications, including email communications, and other documents relating to their purchase, sale, receipt or distribution of circumvention devices, including but not limited to the PS3 Jailbreak devices, the backup manager or any other hardware or software that bypasses technological copyright protection measures in SCEA’s PlayStation®3 computer entertainment system, and defendants shall not delete, remove, transfer or in any way dispose of such communications and documents;

    3. Pursuant to 17 USC § 1203(b)(2), all circumvention devices in defendants’ possession, custody or control are ordered impounded, including any or all of the PS3 Jailbreak devices, any copies or versions of backup manager or any other hardware or software which bypasses technological copyright protection measures in SCEA’s PlayStation®3 computer entertainment system. Defendants shall immediately deliver the devices to SCEA’s attorneys at Townsend and Townsend and Crew LLP, Two Embarcadero Center, Eighth Floor, San Francisco, CA 94111 Attn: Timothy R Kahn, Esq;

    4. The $5000 security posted to secure the temporary restraining order, Doc #36, shall suffice as security for this preliminary injunction;

    5. Plaintiff shall serve defendants, defendants’ resident agents or counsel with a copy of this order;

    6. This order shall remain in effect until further order of the court.

    garyopa over at PSX-Scene has posted an interesting article today, releasing many possible recent court documents.

    To quote:

    In this boring legal filings by Sony, it now covers not just PSJailbreak, but also names PSGroove, PSFreedom, OpenPSJailbreak, and they have filed printouts from various blogs, forums, with comments and tutorials people have been writing up on how to use these various programs. They even mention of course the phone ports & TI84 calc. hacks.

    Sony is using this information, to get the courts to order up faster service, to force the various ISP’, Domain Register’s, and Web Hosting Services to give up the personal info on their clients so that can serve more court papers on those people, and issue DMCA takedown notices to shut down various sites.

    So for the Judge has only granted one order so far, this one is directed to YAHOO! to within 5 business days to turn over all the information they have on a “vladgazoune@yahoo.com”, all IP’s he used to access his mail, his personal info stored by Yahoo, his email of course, and other logs.

    This E-Mail address is the one that was used to rent the mail-drop box in Texas used by http://shoppsjailbreak.com as their virtual office for orders, shipments, registering the domain name, etc.

    Recently, that above name site which also goes under the company name of Zoomba stop using the “.com” domain and now is operating under a http://shoppsjailbreak.net domain. — Plus also the http://psjailbreakcanada.com site which seems to point IP wise to the older site, has suddenly been changed to DOJ/IPR/ICE notice that has been used in the past for “Torrent/Movie” site take-downs!

    Anyhow, here is all the public court documents you can read thru them now, and see just what SCEA has been printing out about yourself online, they are asking the court they need to findout the true identify of everyone that sells, makes, offers for sale, or even has just knowledge of the real people behind any project called PSJailbreak, PSGroove, OpenPSJailbreak, PSFreedom.

    Don’t be surprized if the next few days, you see less sites online, or you find yourself answering the door to a person serving you a Summons to Appear! — The good reading stuff is the PDF’s called Exhibit or Exhibits!

    Now this is a very interesting case, according to the reports at the Playstation 3 forums, it seems Sony has blocked “75% of 3rd Party USB” peripherals with their latest firmware update. Yep, that means anything not licensed by Sony can be disabled via USB, which unfortunately includes many 3rd party controllers (such as the PS3 MadCatZ controller).

    A surprising and poor move by Sony. Even more of a reason to not update.

    Information from Sony about Counterfeit controllers which was posted a few days ago:
    “Counterfeit PlayStation®3 Wireless Controllers, which are practically identical in appearance to genuine PlayStation®3 Wireless Controllers, have been discovered in the market. SCEA advises consumers to be cautious when buying PlayStation®3 Wireless Controllers from uncertain sources as the quality, reliability and safety of counterfeit products is uncertain, and in some cases, may be dangerous. It is possible that some counterfeit product may ignite or explode, resulting in injury or damage to the user, your PlayStation®3 computer entertainment system, or other property. Moreover, SCEA does not support continued functionality of counterfeit or unlicensed controllers in system software updates and these devices may cease to function in the future because of system software updates.”

    Let us know, if you have updated, of 3rd party USB devices you have found not working.

    While the forum may be filled with PS Jailbreak related post’s, there is other none hack related news and whilst most have those that have PS Jailbreak have forgotten about the Other OS, others have not, IGN reports that Sony has responded to the Other OS lawsuit and it seems that Sony are trying to wriggle their way out of their obligations, but whats new, here is what IGN said:

    The attorneys representing Sony Computer Entertainment America have responded to a class action complaint filed against the company for removing the other ‘Other OS’ feature from the PlayStation 3.

    Sony removed the feature in April due to potential security issues as part of PS3 firmware update v3.21. Seven total class action lawsuits were filed against the company soon after, and in July, a judge ruled to consolidate all the lawsuits into one complaint.

    Last week, however, Sony’s attorneys filed a motion for the court to strike the class allegations and to dismiss the case.

    Sony contends the plaintiffs’ claims that the company advertised the Other OS feature the later removed it – depriving PS3 users of software features – is contradicted by the explicit terms stated in SCEA’s written express warranty, the System Software License Agreement and the PSN Terms of Service.

    “These contracts specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates,” the motion reads. “Plaintiffs therefore cannot succeed in any of their claims because SCEA’s alleged alteration/disablement of PS3 features including the Other OS, was entirely proper and authorized.”

    Sony’s motion also said the complaint fails to provide any mass media advertising campaign, statements by SCEA, or PS3 packaging that referenced the ‘Other OS’ feature.

    “Instead, it includes a mix of quotes drawn from obscure articles and unrelated third party publications, and a smattering of out of context and incomplete references to a few pages of SCEA’s website and user manual,” Sony said.

    Sony went on to list several reasons why the court should strike the class allegations from the complaint and pointed to the fact all plaintiffs did not use the Other OS feature in the same manner, if at all.

    “One plaintiff never installed Linux during the more than two years he owned his PS3; two plaintiffs used the Other OS feature only to do things equally available through the PS3 native operating system; one plaintiff supposedly also played Linux-specific games; and the last plaintiff used Linux extensively, including for electronic mail, word processing, spreadsheet software, and other ‘productivity applications.’”

    Sony later referenced various message board postings from PS3 owners admitting they had “no idea that the PS3 even had an Other OS function or Linux functionality.”

    The company also cited numerous postings from owners who stated they “did not purchase the PS3 because of the Other OS feature and did not use it” and others saying they downloaded the update because “they did not care about the Other OS feature.”

    Both parties will be heard before a judge on November 4, 2010. The plaintiffs, meanwhile, have requested that Sony turn over internal documents regarding the decision to remove the ‘Other OS’ feature.

    “We are in the process of reviewing Sony’s Motions to Dismiss and to Strike,” a representative from the interim co-lead counsel for the plaintiffs told IGN. “These types of motions are fairly common at this stage of the litigation and we believe we have strong arguments for why they should be denied.”

    “We plan on vigorously opposing these motions and we hope to have them decided in November. In the meantime, we have requested that Sony turn over its internal documents about why the ‘Other OS’ feature was removed and we look forward to reviewing those materials.”

    The situation is going from bad to worse for the PSJailbreak team as today Hong Kong and Russia are banning the sales, and distribution of PSJailbreak.

    In Hong Kong, Sony is busy ripping packages open at customs and seizing all forms of PSJailbreak.

    Likewise in Russia, PSJailbreak in deemed illegal:

    “Please note that any method of distributing counterfeit games for the PS3 is illegal. As is illegal to manufacture, sale and use of any technical means to neutralize the defense of the use of pirated products.”

    So if you PSJailbreak has not arrived, not arriving, then this is a good indicator that its stuck and being seized :( .

    For those who still enjoy playing your PS2 games, it seems Sony may have finally heard your plea. Sony today has filed a patent for an adapter that will make the PS3 backwards compatible.

    To quote:

    A schematic of the proposed adapter (200) shows the device has its own processor, a DVD decoder/emulator, sound processor, and graphic processor.

    It seems the proxy and DNS methods were short lived this time, garyopa PSX-SCENE’s admin has reported that Sony have blocked all routes, here is what he says in his forum post:

    Starting this afternoon, PSN was updated, so previous bypass like the simple DNS change over to 67.202.81.137 has now been blocked, along with other forms of proxy tools like Logan5′s program.

    If you wish to use your PS3 online now, or any PSN feature, you will have to update v3.42, and forgot about using for now any of those PSGroove, PSJailbreak, PSFreedom type of devices.

    I have not see any update yet from the owner of the DNS private box, that tons have been have been using, you can check here and see if maybe he has figured out a work-around, but please don’t all go tweeting him at once, he does have a life, and was doing this out of the kindest of his heart, for all the millions of PS3 owners wishing to stay online, using the nice “Jailbreakable” v3.41 firmware!

    And everyone should at least by thankful for the time they so-far have been able to stay online, but Sony seems to be HOT on track in cutting out your options to stay on v3.41.

    Sony is on a roll, they have stopped the sales of PSJailbreak in Australia, Germany and the Netherlands and now they are working on getting rid of it in Sweden. Looking over at PSJailbreak.com you can see the number of resellers have dropped significantly. Seeing the high win record for Sony, what do you guys think will be the verdict of this court case?

    These must be the worst few days over at Sony. According to internet reports, a well known Spanish hacker Demonhades had his blog hacked yesterday (about 3 times), and his SQL publicly leaked. The hackers managed to wipe out his entire FTP, forcing his site to be temporarily shutdown (still closed as of now).

    The leaked SQL however contained illegally obtained information for the PS3, such as service manuals, various of other documents and information, and programs/SDKs – all now spreading over the internet like a wild fire.

    The leak may further hurt Sony as hackers begin to get their hands on this illegal data and may open up more doors for the PS3, especially with PSJailbreak just around the corner.
